1. Scope

These Terms and Conditions (T&C) apply to all orders placed via our online shop berkantyazgan.com by consumers. A consumer is any natural person who enters into a legal transaction for purposes that can be predominantly attributed neither to their commercial nor to their independent professional activity.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order. By clicking the order button you submit a binding offer. The contract is concluded with our order confirmation by email.

4. Prices and Shipping Costs

All prices are final prices (small business according to § 19 UStG, no VAT charged) plus shipping costs. You will find the shipping costs here.

5. Payment

Payment is processed via our payment service provider Stripe. Accepted payment methods: credit card (Visa, Mastercard, Amex), SEPA direct debit, Apple Pay, Google Pay, Klarna.

6. Delivery

Delivery takes place within the stated delivery time (see Shipping). For Pre-Order pieces, the shipping date stated in the product applies.

7. Right of Withdrawal for Consumers

Withdrawal Instructions

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (Berkant Yazgan, Projensdorfer Str. 81a, 24106 Kiel, hello@berkantyazgan.com) by means of a clear statement (e.g. a letter sent by post or email) about your decision to withdraw.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery type other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received your notification of withdrawal.

8. Warranty

Statutory warranty rights apply. In addition, we grant an extended 6-month quality warranty on embroidery, stitching and fabric for Heritage Pieces.

9. Dispute Resolution

The EU Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Final Provisions

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall not be affected.
